1. Agreement to Terms
By accessing or using PhonicFlow's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). PhonicFlow is a product of Etherwise ("Company", "we", "our"). If you do not agree to these Terms, do not use our Services.
2. Description of Services
PhonicFlow provides AI-powered inbound call handling, job booking, SMS notifications, and related communication services for home service contractors. Our AI agent answers calls on your behalf, schedules appointments, triages emergencies, and sends confirmations based on your configured preferences.
3. Account Registration
To use our Services, you must provide accurate business and contact information during setup. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
4. Payment Terms
Payments are processed by Paddle.com ("Paddle"), our Merchant of Record. Paddle handles all billing, invoicing, sales tax collection, and payment processing. By subscribing, you agree to Paddle's terms of service in addition to ours.
Pricing is as displayed on our pricing page at the time of purchase. We may update pricing with 30 days' notice. Annual subscriptions are billed as a single payment. The one-time setup fee is charged at the beginning of your subscription.
5. Cancellation
You may cancel your subscription at any time by emailing hello@phonicflow.ai. Cancellation takes effect at the end of your current billing period. No partial refunds are provided for unused portions of a billing period, except as described in our Refund Policy.
6. Acceptable Use
You agree to use PhonicFlow only for lawful business purposes related to your home service contracting business. You will not: use the service for spam, harassment, or illegal activity; attempt to reverse-engineer or copy our AI technology; misrepresent the AI agent as a human when directly asked; or share your account access with unauthorized parties.
7. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for service interruptions caused by third-party providers, telecommunications carriers, internet outages, or force majeure events. Scheduled maintenance will be communicated in advance when possible.
8. Data and Privacy
Your use of our Services is also governed by our Privacy Policy. Call recordings, transcripts, and customer data are stored securely and used only to provide and improve our Services. You are responsible for complying with applicable laws regarding call recording in your jurisdiction.
9. Limitation of Liability
To the maximum extent permitted by law, PhonicFlow and Etherwise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, or business interruption. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless PhonicFlow, Etherwise, and their officers, directors, and employees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
